Pease v. State

District Court of Appeal of Florida, Second District
Dec 7, 1990
570 So. 2d 1116 (Fla. Dist. Ct. App. 1990)

Opinion

No. 89-03027.

December 7, 1990.

Appeal from the Circuit Court for Hillsborough County; Manuel Menendez, Jr., Judge.

James Marion Moorman, Public Defender, and Megan Olson, Asst. Public Defender, Bartow, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Donna A. Provonsha, Asst. Atty. Gen., Tampa, for appellee.

We affirm the defendant's convictions. Since the defendant's sentence constitutes a more than one cell increase for a violation of probation, see Lambert v. State, 545 So.2d 838 (Fla. 1989), we reverse and remand for resentencing within the range permitted by the guidelines.

LEHAN, A.C.J., and HALL and PARKER, JJ., concur.
