On order of the Court, the application for leave to appeal from the June 24, 1999 and August 31, 1999 decisions of the Court of Appeals is considered and, it is DENIED, because we are not persuaded that the question presented should be reviewed by this Court. The motion to expand record and consolidate is also considered, and it is DENIED.


We would reverse the Court of Appeals orders of June 24, 1999 and August 31, 1999, and remand this case to the Court of Appeals with directions that it reinstate plaintiff's claim of appeal. The claim filed January 29, 1999, and refiled March 19, 1999, lists the trial court's order denying reconsideration as well as its earlier order granting summary disposition. Thus, the claim is not premature, but is timely for purposes of MCR 7.204(A)(1)(b).
