The petition in this case was filed in November 2018, and the requested place of trial is Seattle, Washington. One issue in the case has been resolved. (See Doc. 15.) By order of August 11, 2011 (Doc. 43), we denied petitioner's motion for partial summary judgment. Since then the parties have been conducting discovery (including international discovery).
Our order of August 15, 2022 (Doc. 62), has required that status reports be filed every 90 days. The most recent status report was filed November 6, 2023; and the next status report would be due February 5, 2024. However, the November 2023 status report states:
8. Respondent requests that this case be set for trial at a date and time certain.
9. Petitioner requests that this case not be set for trial until it can determine whether [international discovery has been completed].
10. Petitioner further requests this Court order Petitioner to provide a status report on January 5, 2024, describing the progress it has made in obtaining the additional documents . . . .
It is
ORDERED that our order of August 15, 2022 (Doc. 62), requiring status reports every 90 days is hereby vacated. It is further
ORDERED that, no later than January 5, 2024, the parties shall file a joint status report (or, if that is not expedient, then separate reports) that shall include: (1) a statement whether Seattle remains the requested place of trial; (2) each party's estimate of the length of the trial; and (3) a statement whether the parties could be ready for trial in May 2024.
