On August 11, 2021, the Court issued an order (Doc. 43) denying petitioner's motion for summary judgment and setting out material facts that appear to be in dispute. On September 10, 2021, the parties filed a joint status report (Doc. 44) that states, among other things, that "by mid-October 2021, petitioner plans to file a motion seeking to submit a letter rogatory". It is

ORDERED that, no later than October 18, 2021, (a) petitioner shall make an appropriate filing and (b) the parties shall file a joint status report (or, if that is not expedient, then separate reports) setting forth their proposals for a schedule for further proceedings.
