An appeal having been taken from an order of the Supreme Court, New York County, entered on or about July 27, 2016, And defendants having moved to stay the July 27, 2016 order, as well as staying the evidentiary hearing ordered therein that was scheduled for October 27, 2016, and to stay plaintiff's CPRL 5229 motion until after decision on the interlocutory appeal, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, it is Ordered that the motion is granted. The Clerk is directed to maintain the appeal on the calendar for the January 2017 Term.
