Appeal from a decision of the Civil Court of the City of New York, Queens County (Diccia T. Pineda-Kirwan, J.), dated April 20, 2006, deemed from a judgment of the same court entered January 28, 2008 (see CPLR 5520 [c]). The judgment, after a nonjury trial, dismissed the complaint.

Judgment affirmed without costs.

For the reasons stated in Dilon Med. Supply Corp. v Travelers Ins. Co. (___ Misc 3d ___, 2009 NY Slip Op ____ [No. 2008-223 Q C], decided herewith), the judgment is affirmed.
