Opinion

Case No. 2D19-1805

01-03-2020

Christina PAYLAN, M.D., Appellant, v. Lyann GOUDIE, Esq. and Goudie & Kohn, P.A., Appellees.

Christina Paylan, M.D., pro se. Elizabeth C. Tosh and Daniel A. Shapiro of Cole, Scott & Kissane, P.A., Tampa, for Appellees.

Christina Paylan, M.D., pro se.

Elizabeth C. Tosh and Daniel A. Shapiro of Cole, Scott & Kissane, P.A., Tampa, for Appellees.

PER CURIAM.

Christina Paylan, M.D., challenges a nonfinal injunctive sanction order finding her to be a vexatious litigant and subject to prefiling requirements for future actions. We treat the notice of appeal as a petition for writ of certiorari, see Fla. R. App. P. 9.040(c) ("If a party seeks an improper remedy, the cause shall be treated as if the proper remedy had been sought ...."); Harris v. Gattie, 263 So. 3d 829, 830 (Fla. 2d DCA 2019) (treating notice of appeal of order forbidding Harris from filing further pro se papers in the case and any other future case as a petition for writ of certiorari), and we deny the petition.

Petition denied.

CASANUEVA, LaROSE, and SMITH, JJ., Concur.
