Pauley v. F J Trucking Co., Inc.

Appellate Division of the Supreme Court of New York, Second Department
Feb 1, 1960
10 A.D.2d 629 (N.Y. App. Div. 1960)

Opinion

February 1, 1960

In an action to recover damages for personal injuries, and for medical expenses and loss of services, the appeal is from an order which granted respondents' motion for summary judgment striking out appellants' answer and directed an assessment of damages. Order reversed, with $10 costs and disbursements, and motion denied. The record presents issues of fact which should be resolved after trial. Beldock, Acting, P.J., Ughetta, Christ, Pette and Brennan, JJ., concur.
