OPINION AND ORDER


WHEREAS, by letter to the Court dated May 12, 2000, defendant Henry Bushkin requested this Court to (1) directly seek and obtain on his behalf the production of certain documents from a foreign third-party, and (2) allow him to present the testimony of four witnesses (not previously identified or deposed) by teleconference at trial, rather than personal appearance, and

WHEREAS the Court held a conference with the parties on May 19, 2000 by telephone to address the requests; it is hereby

ORDERED that, for the reasons stated by the Court during the conference, defendant's requests are denied.

SO ORDERED.
