WELCH, Judge.

In accordance with the Alabama Supreme Court's opinion in Ex parte Pate, 145 So.3d 733 (Ala.2013), we reverse the trial court's judgment and remand this case to the trial court for proceedings consistent with that opinion.

REVERSED AND REMANDED. BURKE and JOINER, JJ., concur.
WINDOM, P.J., and KELLUM, J., recuse themselves.
