In an action to compel specific performance of a contract for the purchase of real property, order striking out the denials and separate defenses in defendant's answer and granting summary judgment in favor of plaintiff, and order denying defendant's motion to dismiss the complaint, pursuant to rule 113 of the Rules of Civil Practice, unanimously affirmed, with one bill of $10 costs and disbursements. No opinion.
