In the motion respondent represents that this case is still with respondent's Office of Appeals and respondent's counsel has been unable to determine petitioner's opinion as to the granting of the motion. ORDERED that this case is stricken from the Court's April 11, 2022, New York, New York trial session and is returned to the general docket for trial or other disposition.
