Ralph P. Pascucci & Lisa C. Pascucci Petitioners v. Commissioner of Internal Revenue Respondent

ORDER

David Gustafson Judge

On April 1, 2021, we ordered that this case and formerly consolidated Docket No. 2966-19 be severed because of a conflict that arose between the parties. Since then petitioners in this case have filed status reports every 90 days. On January 13, 2022, petitioners filed a status report that advised that the conflict between the petitioners in this case and those in No. 2966-19 will be resolved by an agreement that they have reached. Petitioners therefore volunteer to file another status report in 90 days--i.e., by April 13, 2022. However, trial in case No. 2966-19 is scheduled to begin April 4, 2022. We cannot tell whether this case should be consolidated with that case and tried on that schedule, or whether these recent developments have affected the appropriateness of that trial date for either case. It is therefore

ORDERED that, no later than February 18, 2022, petitioners shall file a status report or an appropriate motion.
