ORDER Trial court case number: 1492372 Trial court: 228th District Court of Harris County

Appellant seeks a fifth extension of time. In support of his motion for extension, counsel asserts that he sought to supplement the record, but because of Hurricane Harvey, he was unable to obtain a timely ruling from the trial court. He also contends that his requested extension is unopposed.

Despite our previous warning that we would not grant any additional extensions on Appellant's brief, we are willing to grant one more extension in light of the difficulties associated with the hurricane. See Emergency Order Authorizing Modification and Suspension of Court Procedures in Proceedings Affected by Disaster, Misc. Docket Nos. 17-9091 and 17-010 (Tex. and Tex. Crim. App. Aug. 28, 2017), available at http://www.txcourts.gov/media/1438759/179091.pdf. Absent a showing of exceptional circumstances, this is the final extension available on Appellant's brief.

Accordingly, we grant an extension until October 13, 2017.
