Pascale v. Department of Insurance

District Court of Appeal of Florida, Third District
Jun 15, 1988
525 So. 2d 922 (Fla. Dist. Ct. App. 1988)

Opinion

No. 87-2389.

May 3, 1988. Rehearing Denied June 15, 1988.

Appeal from the Department of Insurance.

Gatlin, Woods, Carlson Cowdery and Thomas F. Woods, Tallahassee, for appellants.

William W. Tharpe, Jr., Tallahassee, for appellee.

Before SCHWARTZ, C.J., and BARKDULL and FERGUSON, JJ.

Finding that the evidence of "sliding" did not meet the test of clear and convincing proof required by Ferris v. Turlington, 510 So.2d 292 (Fla. 1987) (decided after the initial hearing in the instant matter) we reverse the administrative order revoking and suspending the appellants' two licenses to sell insurance with directions to dismiss the proceedings against them.

A term used in the insurance industry which means adding coverage which the client had not requested.

Reversed and remanded with directions.
