DECISION & ORDER ON MOTION

Motion by the respondent Daniel M. Donovan, Jr., in a proceeding pursuant to CPLR article 78 for leave to file his answer under seal, to serve redacted copies of the answer on the other parties to the appeal, and to enlarge the time to serve and file his answer.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the motion is granted, the answer shall be filed under seal, the copies of the answer served on the parties may be redacted to omit material contained in the supporting affirmation filed in connection with the application for the appointment of a special district attorney, and the movant's time to serve and file the answer is enlarged until May 3, 2013.
