ORDER DENYING PETITION FOR WRIT OF MANDAMUS


Upon consideration of Petitioner Earle A. Partington's petition for a writ of mandamus, the papers in support, and the records and files herein, it appears: (1) Petitioner seeks a writ of mandamus directing the respondent judge to vacate an order entered in Rogers v. Minoo, S.P. No. 01-1-0487, presently pending in the Circuit Court of the First Circuit; and (2) Petitioner fails to demonstrate that he is entitled to a writ of mandamus at this time. Therefore,

IT IS HEREBY ORDERED that the petition for a writ of mandamus is denied without prejudice to Petitioner seeking relief or setting forth his position in the pending circuit court proceeding.
