Order modified so as to provide that the motion is granted upon condition that within ten days after service of the order of this court plaintiff serve the proposed amended complaint and pay to defendant the taxable costs of the action up to the time of making this motion, plus ten dollars motion costs, and as so modified the order is affirmed, without costs of this appeal to either party. All concur.
