ORDER DENYING PETITION FOR WRIT OF MANDAMUS


Upon consideration of Petitioner Eugenie Parnar's petition for writ of mandamus and the papers in support, it appears that: (1) in this petition, Petitioner asks this court to order the district court to vacate the judgment of possession and the writ of possession entered in Hilton Hotel Corp. v. Parnar, Civil No. 1RC04-1-4925; (2) Petitioner has a pending appeal from the judgment of possession and the writ of possession entered in Civil No. 1RC04-1-4925; and (3) a petition for writ of mandamus is not intended to take the place of an appeal. Therefore,

IT IS HEREBY ORDERED that the petition for a writ of mandamus is denied without prejudice to Petitioner raising any points of error in her pending appeal.
