In light of respondent's concession that petitioner received no legal mail during the critical period at issue, petitioner's motion for reinstatement is hereby granted and it is ordered that the above case is reinstated.

Respondent is allowed to and including March 14, 2006, in which to serve a brief on jurisdiction.
