Parkinson v. Syracuse Transit Corporation

Appellate Division of the Supreme Court of New York, Fourth Department
Jan 18, 1952
279 App. Div. 848 (N.Y. App. Div. 1952)

Opinion

January 18, 1952.

Present — Taylor, P.J., McCurn, Vaughan, Kimball and Piper, JJ.

Order modified by striking from paragraph 3 the words "his record of prior accidents; his general competency to operate a bus, and the knowledge that defendant had with respect to the foregoing prior to the 18th day of April, 1951;" and as modified affirmed, without costs of this appeal to either party. Memorandum: Evidence of prior accidents, involving the driver, to establish negligence of the driver at the time of this accident would be incompetent. Proof of the fact that defendant knew of prior accidents of the driver, absent proof of the driver's negligence on this occasion, would not make out a case for the plaintiff. An examination as to the training and experience of the driver will amply disclose his competency or incompetency to operate a bus. All concur. (Appeal from an order granting plaintiff's motion for an examination before trial of defendant, and directing defendant to produce certain books and papers.)
