This case is set for trial commencing at a special session of the Court on March 25, 2024, in Atlanta, Georgia. On November 30, 2023, respondent filed a motion for continuance of this trial. On December 4, 2023, the parties held a conference call with the Court; respondent indicated how, notwithstanding the issue of consolidation, respondent would prefer a continuance of this trial date. Petitioner's counsel indicating on the call they were generally agreeable to a relatively short continuance; however, they oppose consolidation of this case. Since the conference call, the Court has also reviewed its schedule and holding trial of this case in May 2024 is unlikely, based on other trial commitments.
Considering the foregoing, it is
ORDERED that on or before December 15, 2023, petitioner is to file a response to respondent's motion for continuance, addressing both consolidation of this case with Parkerson Sands and continuance of this trial to a week in August or September 2024.
