DECISION & ORDER ON MOTION

Motion by respondent for a stay pending determination of respondent's motion for leave to reargue an appeal from an amended final judgment of the Civil Court of the City of New York, Kings County, entered May 30, 2019, which was determined in a decision and order of this court dated May 21, 2021, or, in the alternative, for leave to appeal to the Appellate Division from this court's decision and order. Cross-motion by appellant to amend an interlocutory judgment dated October 12, 2021.

Upon the papers filed in support of the motion and cross motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied as moot; and it is further, ORDERED that the cross motion is denied.
