United States Court of Appeals, District of Columbia Circuit
May 24, 2007
No. 04-7041 (D.C. Cir. May. 24, 2007)

Opinion

No. 04-7041.

Filed On: May 24, 2007.

BEFORE: Henderson and Griffith, Circuit Judges, and Silberman, Senior Circuit Judge

A separate statement by Senior Circuit Judge Silberman is attached.

ORDER

Upon consideration of appellees' unopposed motion to stay issuance of the mandate, it is

ORDERED that the motion be granted. The Clerk is directed to withhold issuance of the mandate until August 7, 2007. Silberman, Senior Circuit Judge: Although the District's motion for stay only indicates it "may" petition for certiorari, since appellants did not object, I assume it is understood that the District intends to petition for review in the Supreme Court. If it did not so intend, in my view, it would be inappropriate for it to have sought the stay. Boim v. Quranic Literacy Institute, 297 F.3d 542, 543-44 (7th Cir. 2002) (Rovner, J.).
