WITHDRAW PENDING MOTIONS

Pursuant to the parties' Joint Status Report and Request to Withdraw Pending Motions, it is hereby ordered that:

1. Defendant's Motion to Dismiss and Motion to Transfer are withdrawn and the associated briefing schedule vacated;

2. The parties shall file a Joint Motion For Provisional Certification Of Settlement Class And Preliminary Approval Of Class Action Settlement no later than October 26, 2011; and

3. The Court shall consider the parties' Joint Motion For Provisional Certification Of Settlement Class And Preliminary Approval Of Class Action Settlement on November 16, 2011, at 9:00 a.m.

4. The Case Management Conference scheduled for December 15, 2011, is vacated.
