Parkchester Preserv. Co. v. Lambert, Robert & Josephine


It is Ordered that the tenants-appellants' motion for an enlargement of time to perfect the appeal and to continue the stay is granted on condition that tenants-appellants: 1) perfect their appeal by no later than the March 2016 term - the filing deadline is January 12, 2016; 2) continues paying use and occupancy in the amount reserved in the most recent lease agreement on or before each subsequent rental due date, without prejudice, and 3) shall not operate the subject washing machine, pending determination of the appeal.In the event of tenants-appellants' failure to comply with the foregoing conditions, landlord-respondent may move on five days notice for an order vacating the stay.
