PAPPAS HARRIS CAPITAL, LLC, Appellant v. ADVANCE HYDROCARBON CORPORATION, AQUA TERRA U.S. HOLDINGS, LLC, CORY HALL, AND MARK GANDY, Appellees
On Appeal from the 295th District Court Harris County, Texas Trial Court Cause No. 2020-10778
Panel consists of Chief Justice Christopher and Justices Bourliot and Spain.
ORDER
PER CURIAM
On October 9, 2023, appellant filed a motion to allow the filing of in-camera documents that are held by appellee's counsel, namely a proposed bill of sale, a proposed deal concerning intellectual property, and an asset purchase agreement that were previously propounded to the trial court on April 25, 2022 for its own in-camera inspection and subsequently returned to appellee's counsel. The motion reflects it is unopposed while appellee's counsel wants to ensure that claims of attorney-client privilege are maintained through the in-camera filing. We hereby grant the motion as follows.
We order appellee's counsel to provide to the clerk of this court by December 7, 2023, on a thumb drive in electronic form and arranged and indexed and bookmarked, copies of the bill of sale, proposed deal concerning intellectual property, and asset purchase agreement that were propounded to the trial court on April 25, 2022 for its own in-camera inspection. Those documents shall be accompanied on the thumb drive with an affidavit attesting that they are the same documents that were submitted to the trial court for its in-camera inspection. This court will not post the documents on the court's website, and the providing of such records to the clerk of this court will not itself be viewed as a waiver of attorney-client privilege in any way. Parties will not be granted access to the records. Pending further order of this court, the records will be returned to appellee's counsel contemporaneous with the issuance of this court's mandate.
