Robert Pann v. Randy Rewerts

LC No. 22-028593-CZ

Christopher P. Yates Presiding Judge David H. Sawyer Douglas B. Shapiro Judges

ORDER

The complaint for mandamus is DISMISSED for lack of jurisdiction. Although plaintiff employs the term "mandamus" liberally throughout his complaint and brief in support, it is clear from the nature of the claims asserted and the relief sought that plaintiff is not seeking mandamus relief. Rather, his complaint and brief reflect that this is an original civil action concerning prison conditions. A civil action concerning prison conditions must be brought in the circuit court or court of claims, as appropriate, not in the Court of Appeals. MCL 600.5501. This order does not preclude plaintiff from initiating suit in the court of claims if appropriate.
