AMARBIR PANJHAZARI & RAVINDER PANJHAZARI, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Mark V. Holmes, Judge

This case is on the Court's June 12, 2023 trial calendar for Buffalo, New York. On April 13, 2023 respondent moved to remand the case for a supplemental determination by the IRS. He was was unable to state in his motion whether the Panjhazaris opposed the motion. We issued an order to them to show cause why their case should not be remanded. A check of the Court's records shows that they did not submit any opposition. It is therefore

ORDERED that the Court's April 21, 2023 order to show cause is made absolute and respondent's April 13, 2023 motion to remand is granted. It is also

ORDERED that this case is remanded to respondent for a new CDP hearing. It is also

ORDERED respondent's May 12, 2023 motion for a continuance is granted in that this case is stricken from the Court's June 12, 2023 Buffalo, New York trial calendar. It is also

ORDERED that this division of the Court retains jurisdiction. It is also

ORDERED that on or before August 17, 2023 respondent shall file a supplemental notice of determination from IRS Appeals or a status report describing any progress.
