By order of May 28, 1998, the application for leave to appeal was held in abeyance pending the decisions in Suttles v. Department of Transportation (Docket No. 106119) andBrown v. Department of Transportation (Docket No. 106359). On order of the Court, the decision having been issued in Suttles v. Department of Transportation, supra, on June 9, 1998, 457 Mich. 635 (1998), and the appeal in Brown v. Department of Transportation (On Rehearing), supra, having been dismissed by stipulation of the parties in an order issued on March 3, 1999, the application is again considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.
