The panel has voted to grant the petition for panel rehearing.

The memorandum disposition filed on October 23, 2006 is vacated. Petitioner may file a supplemental opening brief within 42 days of the filing of this order. Respondent may file a supplemental answering brief within 28 days of the service of the supplemental opening brief; and any optional supplemental reply brief is due within 14 days of service of the supplemental answering brief.

If supplemental briefing is not received within 42 days of the filing of this order, the case will be submitted on the briefs previously filed.
