It is Ordered that the motion and cross motion are consolidated for disposition. It is further Ordered that plaintiff-respondent's motion to dismiss the appeal is granted, unless defendant-appellant perfects her appeal by no later than the April 2012 term - the filing deadline is February 7, 2012. In the event of defendant-appellant's failure to comply with the foregoing condition, plaintiff-respondent may move on five days' notice for an order dismissing the appeal.
