Order reversed, with ten dollars costs and disbursements, and motion granted, with ten dollars costs to abide event.


For the reasons assigned in the opinion in the case of Thomson v. Perkins (ante, p. 656), decided herewith, the order appealed from should be reversed, with ten dollars costs and disbursements, and the motion granted, with ten dollars costs to abide the event. Barrett, Rumsey, Patterson and O'Brien, JJ., concurred.
