It is Ordered that the plaintiff-respondent's motion seeking to dismiss the appeal is granted, unless defendant-appellant perfects his appeal by no later than the February 2017 term - the filing deadline for which is December 14, 2016. In the event of defendant-appellant's failure to comply with the foregoing condition, plaintiff-respondent may move on five days' notice for an order dismissing the appeal. The remainder of the motion seeking to release the funds on deposit with the Finance Administrator of the City of New York is denied, as premature.
