ORDER ACCEPTING FINDINGS, CONCLUSIONS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE


On March 14, 2005, United States Magistrate Judge Jeff Kaplan made Findings and a Recommendation that this Court extend the time for Petitioner to file a notice of appeal. Plaintiff filed objections, and this Court has made a de novo review of the issue. The objections are overruled, and the Court accepts the Findings and Recommendation of the United States Magistrate Judge.

The Court has previously denied Petitioner a certificate of appealability.

SO ORDERED.
