Packer v. Rapoport

Appellate Division of the Supreme Court of New York, First Department
May 24, 1949
275 App. Div. 820 (N.Y. App. Div. 1949)

Opinion

May 24, 1949.

Present — Glennon, J.P., Dore, Callahan, Van Voorhis and Shientag, JJ.

Orders unanimously reversed, with $20 costs and disbursements to the appellant, and the motion denied. While we agree in the abstract with the views expressed by the Justice at Special Term, the record in this case does not satisfy us that there was sufficient basis for ordering a reference in this case particularly in view of the long delay in raising objections.
