MOTION AND PROCEDURAL RULINGS

On review of order certifying a conflict. The court determines that a conflict exists. The parties are to brief the issue stated at page 3 of the court of appeals' Judgment Entry filed June 16, 2006:

"Whether the Medicaid eligibility rales are those in effect at the time of the creation of an inter vivos trust or those in effect on the date of eligibility review?"

MOYER, C.J., dissents.

The conflict cases are Metz v. Ohio Dept. of Job Family Servs. (2001), 145 Ohio App.3d 304, Martin v. Ohio Dept. of Job Family Servs. (1998), 130 Ohio App.3d 512, Prior v. Ohio Dept. of Job Family Sens. (1997), 123 Ohio App.3d 381, and Miller v. Ohio Dept. of Job Family Sens. (1995), 105 Ohio App.3d 539.

Sua sponte, cause consolidated with 2006-1207, Pack v. Osborn, Licking App. No. 05 CA 83, 2006-Ohio-2253.
