ORDER
On June 30, 2004, Plaintiffs' Motion to Amend Complaint, Defendants' Motion to Compel, and Defendants' Motion for Protective Order was heard by Magistrate Judge Alba in the above-entitled matter. Present and representing defendants was Martha Knudson of Richards Brandt Miller Nelson. Present and representing plaintiffs was Craig Taylor of Craig L. Taylor and Associates.
The court, having heard oral argument on the motions, having reviewed the pleadings and exhibits, and good cause appearing therefor, the court orders as follows:
1. All Plaintiffs are ordered to produce federal and state tax returns for those years that they were each doing business in the State of Utah. Tax returns to be produced to defendants under the Protective Order stipulated to between the parties.
2. Defendants' Motion for Protective Order is granted — Plaintiffs having withdrawn their request for defendants' employment and training records.
3. Plaintiffs have withdrawn their Motion to Amend Plaintiffs' Complaint. Defendants have stipulated to allow Plaintiffs to file a revised third amended complaint adding claims against the current Kaysville City Ordinance, a Fourth Amendment claim, and a Fourteenth Amendment claim. Defendants do not stipulate to allowing plaintiffs to name the current defendants in their individual capacities.
