By Order of Dismissal for Lack of Jurisdiction entered January 13, 2023, this case was dismissed for lack of jurisdiction on the ground that petitioner failed to file an amended petition, as directed by the Court. On February 3, 2023, the Court received from petitioner and lodged a First Amended Petition (Doc. 8) and a Request for Place of Trial at Los Angeles, California (Doc. 9).
In view of the foregoing, it is
ORDERED that, on the Court's own motion, the above-referenced Order of Dismissal for Lack of Jurisdiction is vacated and set aside. It is further
ORDERED that petitioner's First Amended Petition (Doc. 8) shall be filed as of the date of service of this Order. It is further
ORDERED that, as petitioner previously filed a Request for Place of Trial at Los Angeles, California on September 26, 2022 (Doc. 2), petitioner's Request for Place of Trial (Doc. 9), lodged February 3, 2023, shall remain lodged and will not be filed.
