An appeal having been taken to this Court from an order of the Supreme Court New York County, entered on or about October 24, 2019, and said appeal having been perfected,

And defendant-appellant having moved for an order striking plaintiffs-respondents' brief for including matters dehors the record, ordering them to resubmit their brief without those portions of the brief which are dehors the record, and extending defendant-appellant's time to file a reply brief until after this motion is decided and a new respondents' brief is filed,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is ordered that the motion is granted to the extent of adjourning the appeal to the June 2021 Term, with a filing deadline for defendant-appellant's reply brief of April 30, 2021, and is otherwise denied, without prejudice to arguments in the reply brief. Entered: March 30, 2021
