On Appeal from the County Criminal Court No. 2 Dallas County, Texas Trial Court Cause No. M21-62169
ORDER
NANCY KENNEDY, JUSTICE
Before us is appellant's June 18, 2024 motion to supplement the record and for extension of time to file his brief. In his motion, appellant points out that the clerk's record does not contain appellant's writ of habeas corpus. Accordingly, we GRANT appellant's motion and ORDER the County Clerk for Dallas County to file, within FIFTEEN DAYS of the date of this order, a supplemental clerk's record containing the writ of habeas corpus.
In the event the County Clerk for Dallas County does not have in its possession the writ of habeas corpus, we ORDER the County Clerk for Dallas County to file, within FIFTEEN DAYS of the date of this order, a letter verifying that the clerk does not have possession of this document.
We note appellant filed his brief on June 20, 2024, two days after filing the underlying motion to supplement the record and for extension of time to file his brief. To the extent that appellant would like to file an amended brief containing record references supporting his fact statement, an amended brief will be due THIRTY days after the supplemental clerk's record is filed. See TEX. R. APP. P. 38.1(g).
We DIRECT the Clerk to send copies of this order to the Honorable Julia Hayes, Presiding Judge, County Criminal Court 2, John F. Warren, County Clerk for Dallas County, and counsel for all parties.
