JOHN OWENS, Appellant v. CATHERINE GABEL ON BEHALF OF H.G., AND CATHERINE GABEL, INDIVIDUALLY, Appellees

On Appeal from the 405th District Court Galveston County, Texas
Trial Court Cause No. 14-CV-0850

ABATEMENT ORDER

On August 17, 2017, appellants filed a joint motion to abate this appeal. The motion states that the parties have reached an agreement to settle their dispute. Because the settlement involves a minor, the trial court will have to appoint a guardian ad litem and approve the settlement. The parties ask that we abate the appeal to permit the proceedings in the trial court necessary to effectuate the agreement. The motion is granted.

The appeal is abated, treated as a closed case, and removed from this court's active docket until October 23, 2017. The appeal will be reinstated on this court's active docket at that time, or when a motion to dismiss the appeal or other dispositive motion is filed, whichever is earlier. The court will also consider an appropriate motion to reinstate the appeal filed by either party, or the court may reinstate the appeal on its own motion.
