JAMES R OWENS & Lisa R. Owens Petitioners v. Commissioner of Internal Revenue Respondent

ORDER

Christian N. Weiler, Judge.

This case is calendared for trial on the Court's December 13, 2021, Jacksonville, Florida remote trial session. On November 30, 2021, petitioners filed an unopposed motion for continuance. The main issue in this case involves a tax liability for which there are Net Operating Loss (NOL) Carrybacks from subsequent years that are currently pending, which significantly impact the 2016 tax year at issue. A continuance would allow respondent time to continue processing the NOL Carrybacks and the parties are likely to settle this case based on the reduced liability.

Upon due consideration, it is

ORDERED that petitioners' motion for continuance of trial is granted and this case is stricken from the Court's December 13, 2021, Jacksonville, Florida remote trial session and is continued generally.
