Action to recover damages for personal injuries sustained as a result of an alleged assault and battery by the defendant, brought to the Superior Court in the judicial district of Stamford-Norwalk, where the court, Novack, J., granted the plaintiff's motion for default for failure to appear; after a hearing in damages, the court, Levister, J., rendered judgment for the plaintiff; thereafter, the court, Lewis, J., denied the defendant's motion to open the judgment, and the defendant appealed to this court. Affirmed.
