Opinion

No. 88-3111.

May 10, 1989. Rehearing Denied June 14, 1989.

Appeal from the Circuit Court for Palm Beach County; Richard B. Burk, Judge.

Duane Eugene Owen, Starke, pro se.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Deborah Guller, Asst. Atty. Gen., West Palm Beach, for appellees.

We dismiss this appeal for lack of jurisdiction. The evidence sought by way of writ of mandamus is within the exclusive jurisdiction of the Supreme Court because of appellant's pending appeal of his murder conviction and death sentence.

HERSEY, CJ., and STONE and WARNER, JJ., concur.
