STIPULATED DISMISSAL AND DISMISSAL WITH PREJUDICE OF ONLY DEFENDANT PACIFICA REALTY III LP FROM PLAINTIFFS' COMPLAINT AND ORDER THEREON.

IT IS HEREBY STIPULATED by and between OUTERBRIDGE ACCESS ASSOCIATION SUING ON BEHALF OF DIANE CROSS AND ITS MEMBERS; DIANE CROSS, An Individual; and LINDA HANKS, An Individual, Plaintiffs, on the one hand, and Defendant PACIFICA REALTY III LP, on the other hand, through their respective attorneys of record that, pursuant to Federal Rules of Civil Procedure; Rule 41 (a)(1) and (2), this Court enter a dismissal with prejudice of ONLY Defendant PACIFICA REALTY III LP, from Plaintiffs Complaint, Case Number: 05cv1201 L (LSP). Each party shall bear their own costs. The dismissal with prejudice of only Defendant PACIFICA REALTY III LP shall not affect the continuing litigation against the remaining Defendants.
