ORDER DISMISSING APPEAL

This is a proper person appeal from an order of the district court granting a motion to withdraw a post-conviction petition for a writ of habeas corpus. Eighth Judicial District Court, Clark County; Abbi Silver, Judge.

The record before this court reveals that appellant orally requested that his petition be withdrawn at an evidentiary hearing held on October 12, 2010. The district court granted this request in an order on October 23, 2010, and filed the notice of entry of order on February 11, 2011. Because appellant requested that his petition be withdrawn, he is not an aggrieved party and he failed to designate an appealable order. Therefore, we

ORDER this appeal DISMISSED.
