Dustin Lee OSBORNE, Appellant v. The STATE of Texas, Appellee

From the 186th Judicial District Court, Bexar County, Texas
Trial Court No. 2014CR9229B
Honorable Jefferson Moore, Judge Presiding

ORDER

Appellant's brief was due on July 27, 2017. On July 24, 2017, appellant's appointed counsel filed a motion stating the reporter's record filed by Ms. Debbie Doolittle is incomplete because the record does not include certain exhibits. Counsel asked this court to order Ms. Doolittle to file a supplemental reporter's record and to reset the due date for appellant's brief.

On July 26, 2017, we granted the motion and ordered Ms. Doolittle file a supplemental reporter's record that contains all six of the exhibits admitted during the hearing on appellant's motion for new trial no later than August 4, 2017.

Ms. Doolittle has not filed the supplemental reporter's record, nor has she responded to this court's attempt to contact her regarding the record. Therefore, Ms. Doolittle is hereby ORDERED to file the supplemental reporter's record that contains all six of the exhibits admitted during the hearing on appellant's motion for new trial no later than August 24, 2017.

If Ms. Doolittle does not file the supplemental reporter's record by August 24, 2017, an order will be issued directing Ms. Doolittle to appear before this court to show cause why she should not be held in contempt for failing to file the record. The clerk of this court shall cause a copy of this order to be served on Ms. Doolittle by certified mail, return receipt requested, and by United States mail. And, because the trial and appellate courts are jointly responsible for ensuring that the appellate record is timely filed, the clerk of this court shall also cause a copy of this order to be served upon the trial court. See TEX. R. APP. P. 35.3(c).
