Opinion

10-18-2022

RANDALL KEITH ORTON, Petitioner and Appellant, v. STATE OF MONTANA, Respondent and Appellee.

ORDER

Appellant Randall Keith Orton, representing himself, was granted an eighth extension of time to file and serve his opening brief on or before October 14, 2022. This Court further ordered that it would grant no further extensions and cautioned Orton that it would dismiss this matter if he failed to file the opening brief by that date. Orton has now requested a ninth extension of time, requesting leave to file his opening brief on or before November 25, 2022. In the accompanying affidavit, Orton asserts that a recent injury necessitates this request.

Having considered Orton's motion and with good cause showing, IT IS ORDERED that Appellant shall file his opening brief on or before November 25, 2022.

IT IS FURTHER ORDERED that no further extensions of time will be granted. If Appellant fails to file his opening brief on or before November 25, 2022, this matter will be dismissed with prejudice and without further notice.

The Clerk is directed to provide a copy of this Order to all parties of record. 1
