DAVID JUAN ORTIZ, Appellant, v. THE STATE OF TEXAS, Appellee.

Appeal from the 406th District Court of Webb County, Texas (TC#2018CRA001475D4).

Before Alley, C.J., Palafox and Soto, JJ.

ORDER

PER CURIAM

The supplemental reporter's record in this appeal was originally due December 7, 2023. On that date, reporter David Laurel attempted to file a supplemental record, but this Court rejected the filing for non-compliance. The clerk of this Court has made multiple attempts to contact the reporter to correct the submission. As of this date, the reporter has not responded or submitted a new filing.

It is therefore ORDERED that appeal is abated and remanded to the trial court for further proceedings and that the appellate timetable be suspended during such time. The trial court shall hold an evidentiary hearing to determine whether Appellant has been deprived of a complete record, and if so, when a supplemental record should be filed in this Court. The trial court clerk shall prepare and forward a supplemental clerk's record containing the findings from the evidentiary hearing and forward the same to this Court on or before February 18, 2024. Further, the transcript of the hearing shall be prepared, certified, and filed with this Court on or before February 18, 2024. This appeal will be reinstated upon the date the complete supplemental clerk's record and reporter's record is filed with this Court.

IT IS SO ORDERED.
